TERMS AND CONDITIONS

When working with Coconuts ‘n CarryOns, you agree to the following terms of business, which supersede any other agreements:

1. Payment Terms:
   • Payment is due within 14 calendar days from the date of the invoice via bank transfer (BACS). If PayPal is the agreed method of payment, the brand or agency will cover any extra charges incurred.
2. Late Payment:
   • If payment is not received within 14 days, a late payment fee of $50 will be added to the outstanding sum, and interest will start to accrue. Late payments from 30 days will incur an interest rate of 8% plus the Bank of America base rate and compensation under the Late Payment of Commercial Debts (Interest) Act 1998.
3. Purchase Orders:
   • If a brand or agency requires a purchase order before receiving an invoice, this must be completed before work commences.
4. Ownership of Content:
   • All images, videos, audio, and written content remain the property of Coconuts ‘n CarryOns unless otherwise agreed in writing. Additional charges will apply for any usage across social media, press, or internal communications beyond the agreed scope.
5. Brand Exclusivity:
   • Any brand exclusivity must be agreed upon in advance and will be subject to a fee per calendar month.
6. Agreement and Project Commencement:
   • The agreement of a fee and due date signifies consent to proceed with the project.
7. Cancellation Policy:
   • Should work be canceled after an agreement is made, a kill fee will be required, calculated as follows:
     • If work has been agreed but not completed: 50% of the total fee is due.
     • If work has been completed but not published: 75% of the total fee is due.
     • If work has been completed and published: 100% of the total fee is due.
8. Alterations and Additional Requirements:
   • Any alterations to a brief or additional requirements may incur an additional fee.
9. Content Approval:
   • If the client requires content approval before publication, an additional fee will apply.
10. Links Policy:
    • All links to a brand’s website will be marked as “nofollow.”
11. Disclosure:
    • All commercial posts will be clearly marked as ‘Advertorial’ at the top of the post and explained as a commissioned post at the end. All social promotion of commercial posts will be clearly marked as #ad or AD.
12. Communication Protocol:
    • Communication regarding project updates and approvals will be conducted via email. Timely responses are appreciated to ensure a smooth workflow.
13. Force Majeure:
    • In the event of unforeseen circumstances, including but not limited to natural disasters, pandemics, or other emergencies, that prevent the execution of the agreement, Coconuts ‘n CarryOns reserves the right to renegotiate terms or cancel the agreement without penalty.

By agreeing to work with Coconuts ‘n CarryOns, you acknowledge and accept these terms and conditions.
